Program Terms & Conditions

Effective Date: August 12th, 2024

The following terms and conditions apply to the Website Design Referral Program (the “Program”) offered by Evergreen Digital Marketing (“Company”). By participating in the Program, you agree to the following terms listed on this page:

1. Eligibility

  • The Program is open to all existing clients, partners, and individuals aged 18 or older.
  • The referrer must be an existing client or have previously interacted with the Company.

2. Referral Process

  • To participate, you must refer a friend, colleague, or business (the “Referral”) to the Company by providing their contact information or ensuring they mention your name when contacting the Company.
  • Referrals must be new clients to the Company. A new client is defined as an individual or business that has not previously engaged the Company for any paid services.

3. Qualifying for a Reward

  • A referral is considered successful when the referred client signs a contract for a new website design project with the Company.
  • The referred client must make the first payment under the terms of their contract for the referral to qualify.
  • Only one referral reward will be issued per new client. If multiple referrers claim the same referral, the reward will be granted to the person whose referral was received first.

4. Reward Options

  • Upon a successful referral, the referrer may choose from the following rewards:
    • $100 Off: A $100 discount on any future website design or maintenance service provided by the Company.
    • Gift Card: A $100 gift card to a retailer chosen by the Company.
    • Charity Donation: A $100 donation made by the Company in your name to a recognized charity.
  • Rewards are non-transferable and cannot be redeemed for cash, except as specified.

5. Limitations

  • There is no limit to the number of referrals a participant can make, and no limit to the number of rewards that can be earned.
  • Referrals must be submitted directly to the Company through official channels (e.g., email, website form) to be eligible.
  • The Company reserves the right to verify the eligibility of referrals and may withhold rewards if any fraud or abuse is suspected.

6. Program Changes and Termination

  • The Company reserves the right to modify or terminate the Program at any time without prior notice. However, any pending qualified referrals before such changes will still be honored under the terms that were in effect at the time of the referral.
  • The Company may also modify the value of the reward, the type of reward, or other aspects of the Program as it sees fit.

7. Disputes

  • In the event of any disputes regarding the Program or the application of these terms, the Company’s decision will be final.
  • Any legal claims arising from the Program will be governed by the laws of Ontario, Canada, without regard to conflict of law principles.
